Everyone there was very professional, knowledgeable, and friendly. My car was totaled, and I was a little intimidated talking with a couple of other lawyers in Greenville. But with Christian and Christian, not only did they answer my questions, but they did so in a way that made what could have been a hectic situation, easy. Overall, an excellent experience with high quality lawyers who truly go above and beyond and really try to get you the results or answers you need.

I met Josh like 4 years ago when my Son was injured at Daycare. He was very concerned about the well being of my Child and Me. Very Understanding Professional and Just a great Staff. If You need a Lawyer that’s all about YOU this is the Place. I just closed a Case on 6/23/2021 from a injury on a Property. They handled everything because no one else would help Me. I’m forever grateful for Your hard Work and Time. Once again Thank You Josh and Sally.

My husband was referred to this law firm from another lawyer after his mother passed away while residing in a nursing home. Matt took on his case and we are pleased with how everything turned out. It took a long, long time to finally settle, but it was worth the wait. The staff here is friendly and I’d be happy to recommend them to anyone needing legal assistance.

I was referred to Harold by a family friend, and I couldn’t be happier. He took the time to listen to my case, answered all my questions and truly treated me like a friend not a client. His knowledge of medical malpractice is priceless he actually successfully won, one of the first medical malpractice cases in Greenville County.

Were You Injured by a Defective Medical Tool?

Surgical staplers can be a helpful medical device when used properly. However, defects in certain varieties of surgical staplers can cause server injuries to patients. A person who is hurt by a defective surgical stapler may sustain injuries that require additional surgery to treat, cause infection, or can be fatal.

If you were injured because of a defective surgical stapler, you may be entitled to compensation for financial damages such as medical bills, lost wages, travel expenses, and noneconomic damages such as pain and suffering. Contact the Christian & Christian legal team today to learn your rights.

What are Surgical Staples Used For?

Surgical staplers are used in a variety of medical procedures as a way to connect or seal tissues. In comparison to stitches, sutures, or medical glues, surgical staples offer the advantages of faster application and easy removal. There are also absorbable types of surgical staples, which dissolve within the body and do not need to be removed by a doctor. Surgical staples may be made of plastic or metal materials.

A doctor may opt for surgical staples in procedures including, but not limited to:

      • Caesarean section (C-section)
      • Sealing skin wounds
      • Vertical banded gastroplasty surgery (stomach stapling)
      • Esophagogastric surgery
      • Organ transplants

      About the Surgical Stapler Recall

Surgical staplers and surgical staples manufactured by Ethicon were recalled by the United States Food and Drug Administration (FDA). Ethicon is a subsidiary of Johnson & Johnson which primarily produces medical closure tools.

The recall order is a “Class 1”-level recall that is focused on the “Ethicon Endo-Surgery Curved Intraluminal Stapler” and “Ethicon Echelon Flex Endopath Stapler.” Class 1 recall orders are reserved for “A situation in which there is a reasonable probability that the use of or exposure to a violative product will cause serious adverse health consequences or death,” according to the FDA.

The recalled types of surgical staplers are considered defective — misshaped staples and other incorrectly manufactured pieces of the devices cause a misfire and resulting injury.

      Surgical Staple Injuries

A misfiring surgical stapler can cause severe injury to a patient. If the device is not operating correctly, issues can occur that leave the wounds open and may cause additional injury. For example, a stapler may fail to fire, contributing to blood loss as a wound is left open. A stapler can also fire inaccurately or too forcefully and damage organs. Or, staples can break and pierce a nearby organ or travel into the bloodstream. The injuries caused by defective surgical staplers can potentially be fatal.

Defective surgical staplers can cause complications such as:

      • Allergic reactions
      • Infection and sepsis
      • Internal bleeding
      • Blood loss
      • Tissue damage
      • Organ damage

Who is Liable for Surgical Stapler Injuries?

Ethicon and Johnson & Johnson could be liable for damages in cases of injury caused by the “Ethicon Endo-Surgery Curved Intraluminal Stapler” or “Ethicon Echelon Flex Endopath Stapler.” It is possible that other device manufacturers and retailers could be liable for damages if you were injured by another brand of surgical stapler. Your doctor could potentially be liable for damages as well, depending on their knowledge of use risks and their response to any complications.
