What Is Elder Abuse?
Among health and legal professionals, elder abuse is generally defined as the willful infliction of physical injury or harm, intimidation, or unreasonable confinement that results in pain or mental anguish by a caregiver.
Elder abuse includes the following:
- Physical Abuse: Hitting, scratching, shoving, biting, and inappropriate use of restraints.
- Emotional Abuse: Ridiculing, humiliating, intimidating, terrorizing, engaging in demeaning behavior, and scapegoating.
- Sexual Abuse: Tricked, forced, or coerced sexual contact.
- Financial Abuse: Pressuring an elder to divulge valuable information or forcing an elder to modify a will, deed, or trust.
It is crucial to report and prosecute nursing home abuse not only for the sake of your loved one, but as a public service, which can serve as a warning for other facilities that may be prone to the same level of abuse.
What Is Elder Neglect?
Elder neglect, on the other hand, generally refers to the failure of a caregiver to fulfill his or her obligations to the elder person’s care. This can include poor or inadequate nutrition, poor hygiene, lack of clothing, and failure to provide appropriate medical care.
Several different factors can play a part in elder neglect, such as:
- Negligent hiring
- Understaffing
- Poor or insufficient training
Neglect can have some severe and fatal consequences, which includes:
- Dehydration and weight loss
- Pressure ulcers and bed sores
- Slips and falls
- Medical errors
- Amputation
- Choking accidents
- Urinary tract infections
- Sepsis
- Pneumonia
Facilities can also be held vicariously liable for the acts of its employees or third parties contracted to care for residents. If a resident harms or injures another resident, for example, the private security firm that provided staff to maintain safety and order in a facility might be held liable for negligence.
