The objective of this dedication is to honor the residents who live in long-term care facilities and to bring awareness to their rights, which every resident has under federal law. It’s imperative to know what these rights are so that you can recognize when they are being violated, and know how to respond.

About Residents’ Rights Month

More often than any of us would like to admit, residents of long-term care facilities are treated unfairly or without the respect and dignity that they are legally guaranteed. The culture of many nursing homes has led to an overwhelming number of residents experiencing various forms of abuse, neglect and covert infringements on their rights.

Especially in light of the events of 2020 and the impact that those events had on long-term facility residents, there is a particular need to ensure that residents’ rights are “recognized, recovered and reasserted.”

Know Your Rights

In order for us to collectively reestablish residents’ rights, we first have to know what those rights are. All nursing home residents are guaranteed certain rights by the federal Nursing Home Reform Law. These rights include:

  • The right to be treated with dignity and respect
  • The right to privacy
  • The right to develop a comprehensive plan of care with the staff
  • The right to be fully informed about care and treatment options
  • The right to file grievances
There are also protections in case of grievances. If any of the above rights are breached or violated, you have the right and the authority to act.

It’s often the case that the breaching of these rights is seemingly insignificant; Nursing and facility staff members may barge into residents’ rooms without so much as knocking, forsaking privacy and overlooking the fact that these rooms are the residents’ homes. Or a “slight” change will be made to a treatment plan, such as switching up a single medication, and the resident is never consulted, despite the fact that this will directly affect their body.

It can be difficult to detect or know for sure if you or your loved one’s rights are being violated, or to know how to respond, which is where we come in.

How to Take Action

While it is the responsibility of each facility and the individuals who work there to comply with federal law to ensure that residents are given the proper care, the responsibility often falls on the loved ones of residents’ when this fails to be the case. But you never have to fight this battle alone.
